A defendant shall be punished by imprisonment for two years.

The defendant shall be ordered to complete a sexual assault treatment program for 80 hours.

Punishment of the crime

[2015 Highest 1526] The defendant and the victim D (n, 20 years of age) are the persons with disabilities falling under class 3 of intellectual disability. The victim is the persons with disabilities falling under class 3 of intellectual disability.

around 21:00 on March 13, 2015, the Defendant taken the victim’s body in the “F” Ma, a mobile phone camera from the Defendant’s cell phone in Dobong-gu Seoul Metropolitan Government, and posted three copies of the photograph taken as above to the Defendant’s cell phone at around 23:37 of the same month as “J” in the “I” bulletin board of the “H” Kap, an Internet site, with the Defendant’s cell phone at around 14:37 of the same month so that many and unspecified members can be seen against the victim’s will, and the same year from that time

4. From September 2, 200 to September 200, a photograph of the body and sexual intercourse of the victim was posted on the said G site against the victim’s will at least seven times in total, as shown in Appendix 1.

Accordingly, the Defendant distributed or openly displayed photographs taken by the victim’s body, etc., which might cause sexual humiliation or shame on seven occasions in total, against the victim’s will.

[2015 Highest 1846] The defendant and D (n, 20 years of age) are disabled persons falling under class 3 of intellectual disability. The defendant and D (n, 20 years of age) are as follows: the first-time relationship around March 12, 2015, and they were disabled persons falling under class 3 of intellectual disability.

The defendant had his mind to recruit men who will be in sexual intercourse with the above D on the condition that he will take a photograph of sex relationship with the above D and send it to himself.

around March 13, 2015, the Defendant posted a letter on G bulletin board, a website, to recruit men with the same content as above, and had such D sell sex from that time to that time on the condition of receiving accommodation and lodging, such as expenses for telecom and meal, from the name unconstruing male, who reported and contacted the above writing at “F” telecom, located in the Dobong-gu Seoul Metropolitan Government Kel, at around 22:00 the same day.

4. By December 4, 199, entry in the list of offenses is set out.
