A defendant shall be punished by imprisonment for one year.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
As C’s children, the Defendant resided with C in 129 dong 505, 129 dong 405, Sungnam-si, Sungnam-si, with C, and the Defendant’s mother began to suffer dementia from around November 18, 2015, and was unable to make normal judgment due to a mental or physical disorder after receiving dementia diagnosis (GDS 6, CDR 2, and the state of severe pain disorder) from the doctor in charge of the E hospital around November 18, 2015. The Defendant, using a mental or physical state of C, donated real estate owned by C to the Defendant using the real estate as collateral, was able to use the real estate as collateral.
1. Forging a private document;
A. On November 1, 2016, the Defendant prepared a donation contract and proxy form through F in the office Secretary F of the Certified Judicial Scriveners Office. On November 1, 2016, the Defendant: (a) indicated each “C” in the column of the contract, which was used to receive the real estate owned by C; (b) indicated each of the above F’s official seal attached to C’s name on each side; (c) indicated each of the above F’s each of the instant delegation contracts and proxy form, which donated C’s ownership (3/14 of equity interest) to the Defendant, from among the 878 square meters of equity in Gun-si, G, Gun-si, Gun-si, Hasan-si, Ha-si, Y-si, Y-si, Y-si, Y-si, Y-si, Y-si, and indicated that C’s ownership (3/14 of equity interest) was donated to C; and (d) indicated each of the above F’s names was affixed by C.
Accordingly, for the purpose of exercising the right and duty, the Defendant respectively stipulated the gift contract and delegation of the title C, which is a private document related to rights and duties, and the contract and delegation of the donation to the above H.
B. The Defendant prepared a donation contract and proxy form through F of the Secretary General of the Certified Judicial Scriveners Office, and, in order to use the C’s real estate to receive a donation from a residence in the above 505 residence around November 25, 2016, 505.
