Defendant shall be punished by a fine of KRW 1,000,000.
When the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
The defendant, who is her husband, had a resident registration certificate and a seal imprintd in C's home, which is located in the joint name with C, using the chapter of his/her husband, had the mind to move the C shares of the building to the defendant.
1. Forging a private document;
A. On May 26, 2015, the Defendant entered “C: Resident registration number; E; nationality; Republic of Korea; type of resident registration certificate; resident registration certificate; number of use; number of copies issued; number of copies issued; 2; name A; and resident registration number; F; F; etc. in the agent column, the Defendant stated “A: F”, etc. on the proxy form for the issuance of the certificate of seal imprint kept in the above public service center, and carried in inside the above C name.
C’s personal seal impression has also been sealed.
Accordingly, for the purpose of exercising rights and obligations, the Defendant forged a letter of delegation to issue a certificate of seal imprint in C.
B. On May 26, 2015, the Defendant, at the H law office of the 4th floor of the G Building in the Suwon-si District, had the staff of the said law office affix the letter of personal seal impression of C on the following C’s name, stating that “C, I, Ma-si D, 105 Dong 1403 (D apartment)” and “AF, Ma-si D, 105 Dong 1403 (D apartment)” in the box of the gift contract, and attached the letter of personal seal impression of C.
Accordingly, for the purpose of exercising, the Defendant forged C’s gift contract on rights and obligations.
2. Exercising the relevant investigation document;
A. The Defendant submitted a letter of delegation for the issuance of forged C’s certificate of seal imprint at the time, time, and place described in Paragraph 1-A, as stated in Paragraph 1-A, to the employee of the competent office of Suwon District Office as if it was duly formed.
B. At the time stated in paragraph 1-b, the Defendant has the said certified judicial scrivener staff with respect to a forged C donation contract, as stated in paragraph 1-b.
