Reasons
Punishment of the crime
From August 25, 2016, the Defendant is a person who operates the “C” located in Gangwon-gu Seoul Special Metropolitan City.
A terminal operator shall maintain and manage the structure and equipment of a terminal appropriately, and shall not allow the platform, passenger passage, waiting rooms, and other places for passengers to be used by passengers to be used by the bus terminal, and the area for passengers' use and the area for automobiles, excluding platforms, shall be clearly classified by floodproofs, partition lines, and other appropriate methods, respectively, and shall have a duty of care to take appropriate measures, such as installing fences to prevent passengers from entering any place other than the places for passengers' use and to prevent traffic congestion.
Nevertheless, while operating the above “C”, the Defendant did not install a clear fence or partition line, etc., which enables the distinction between the passenger’s place and the vehicle’s place, and did not install a fence to prevent passengers or other general public from entering the terminal site and the neighboring land, thereby clarifying the boundaries between the terminal site and the neighboring land owner. The Defendant left the terminal site alone for several years.
At around 07:10 on December 29, 2018, the Defendant: (a) parked a vehicle at a place for motor vehicle in order to use a terminal; and (b) caused the victim D (59 years of age) who was leaving the terminal to the ticket office by leaving the vehicle, leaving the vehicle at the place for motor vehicle in order to use the terminal, to go off to the ticket office; and (c) had the victim D (59 years of age) suffer from face and patha on the floor by failing to discover the waste log left there; and (d) caused the victim to face and patha for about four weeks of treatment.
