Defendants shall be punished by imprisonment for six months.

However, from the date of the conclusion of the judgment, each of the above two years against the Defendants.

Punishment of the crime

1. On January 2, 2013, the Defendants and C’s cell phone-related Defendants conspired to open a cell phone in the name of Defendant A located in the Nam-gu Seoul metropolitan area and sell a cell phone device as a key phone and distribute profits therefrom.

On January 2, 2013, C and D opened two cell phoness in the name of D as if they opened a cell phone in the victim KT (KT agency) agency in Seo-gu, Seo-gu, Gwangju. On January 2, 2013, they sold to the Defendants around January 2, 2013, and the Defendants reselled two cell phoness purchased from C to buphones.

In fact, C and D had no intention or ability to pay the installment of the device and the user fee of the mobile phone even if they are opened and used through the mobile phone.

Nevertheless, C and D did not pay 3,258,790 won for the installment of the mobile phone and the telecommunications fee even though they deceiving the victim and use two mobile phones in the name of D from the victim as above, thereby acquiring property profits equivalent to the same amount.

As a result, the Defendants conspired with C and D, thereby deceiving the victims to acquire property benefits.

B. On January 2, 2013, at around 18:46, C and D: (a) had the victim SK Telecom Agents, Inc., Inc., Ltd., the Dong-gu Gwangju-dong-gu, by deceiving the victim by the aforementioned methods, sold the Defendants by deceiving the victim through one mobile phone; and (b) did not pay the mobile phone installments and the telecommunications fee of KRW 1,223,950, thereby obtaining pecuniary benefits equivalent to the same amount.

As a result, the Defendants conspired with C and D, thereby deceiving the victims to acquire property benefits.

3. Defendants, and C’s Defendants and C’s Internet-related crimes are the Internet, Internet phone, and cellular phone in the name of D using the passbook, check card, and cellular phone in the name of D.
