A defendant shall be punished by imprisonment for six months.

Punishment of the crime

From January 2, 2018, the Defendant: (a) was affiliated with the victim C, which was operated by the victim C, and was engaged in one-time work at the construction site located in Sin Sinmi-si E; (b) was suspended from January 2, 2018; and (c) did not supply all the labor with a certificate of work performance; and (d) was able to prepare and use a work confirmation document in the name of G, a site warden, in the name of the site warden.

1. On January 2, 2018, the Defendant: (a) indicated “F site” in the “name of the company” column of the work confirmation certificate that he was in possession of a part of D, which was in the vicinity of the Kucheon-gu, Seocheon-si; (b) stated “A, H, I, J, K, and L” in the “number of printed personnel”; (c) stated “6” in the “number of printed personnel”; and (d) stated “date” in the “number” as “F January 2, 2018; (b)” stating “A, H, I, J, K, and L” in the “number”; and (c) for the purpose of exercising “G” as “the date”, the Defendant submitted to the “person in charge of the above G’s name” to forge the certificate of work confirmation, which is a private document verifying the facts in the name of the said G, from the time when the document was forged to January 23, 2018.

On January 2, 2018, between January 2, 2018 and January 23, 2018, the Defendant presented 14 copies of the work confirmation to the above M at the place described in the above paragraph (1) as if the daily worker entered in the work confirmation letter was working at the above construction site on the pertinent date, even though the fact was not work at the above construction site.

As such, the Defendant, by deceiving the above M, received KRW 798,00 from the injured party through the above M, around January 2, 2018, and received KRW 10,374,00 in total over 14 times from that time to January 23, 2018, as stated in the list of crimes in the attached crime.
