A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On May 2020, the Defendant of obstruction of performance of official duties by a deceptive scheme: (a) purchased a two-wheeled vehicle with a strong stalma SR400 wheeler with a strong stalma, and issued a certificate of discontinuance of use of the two-wheeled vehicle with a strong stalma SR400 wheeler with a previous report on disuse; (b) submitted a false report of use of the two-wheeled vehicle with a false stalma as if he/she would use the above stalma without any actual stalma; and (c) received a false report of use of the two-wheeled vehicle with a false stalma as if he/she had acquired it again; and (d)

Accordingly, on July 17, 2020, the Defendant submitted a false report on the use of a two-wheeled automobile at the Jung-gu Office located in Jung-gu, Seoul, Jung-gu, Seoul, to use it again, and filed an application for the re-issuance of a two-wheeled automobile number plate, thereby deceiving a public official in charge of the transportation administration of the above Jung-gu and the public official in charge of the transportation of the above Jung-gu Office, and received one registration number plate C as to the above GTR125.

Accordingly, the Defendant interfered with the legitimate execution of duties concerning the report on the use of two-wheeled vehicles by public officials and the re-issuance of two-wheeled vehicles.

2. On July 17, 2020, the Defendant violated the Automobile Management Act: (a) filed a false report on the use of a two-wheeled vehicle, as described in paragraph (1), in E near Jung-gu Seoul, Jung-gu; and (b) attached the registration number plate of the two-wheeled vehicle to the CR125 E-wheeled vehicle.

Accordingly, the defendant used a two-wheeled automobile number plate under the Automobile Management Act in a fraudulent way without authority for the purpose of exercising it simultaneously.

3. From July 17, 2020 to July 21, 2020, the Defendant illegally used a two-wheeled automobile from around 3.6km section from around 17, 202 to around 3.6km in Yongsan-gu Seoul, Seoul, to the Hate road located in Yongsan-gu, Seoul, and exercised the sign of a public office that illegally used a two-wheeled automobile, such as paragraph (2).
