Punishment of the crime
Defendant
A worked as the management warden of the Gangnam-gu apartment complex from June 2009 to December 2013, and was engaged in the management of the funds and apartment management of the above E apartment apartment complex. Defendant B was the chairperson of the above apartment tenant representative council from early 2009 to the end of the end of 2012. Defendant C was the auditor of the above apartment tenant representative council from around 2010 to the end of the end of 2012, and Defendant C was the chairperson of the above apartment tenant representative council from early 2013 to the end of the end of 2013, and Defendant D was the representative of the above apartment building's floor around 2010.
1. Joint crime by the Defendants - Fraud
(a) According to the Gangnam-gu Seoul Special Metropolitan City Ordinance on the Support for Management of Multi-Family Housing in Gangnam-gu to create a pleasant residential environment, the victim Gangnam-gu subsidized the cost of installing and repairing some facilities of multi-family housing located in Gangnam-gu with the Gangnam-gu budget, and, among them, subsidized 70% of the construction cost in the case of the improvement of facilities for collecting garbage and the repair of bicycle storage facilities;
On February 2, 2010, the Defendants decided to install garbage collection facility construction works, bicycle storage facility repair works, and late door guard room construction works on the above E apartment complex. The total construction cost is KRW 28 million, and the late door guard room installation is not included in the victim Gangnam-gu's support. In the case of improvement of garbage collection facilities, bicycle storage facility repair, the victim's 70% of the total construction cost is subsidized from Gangnam-gu and the remainder 30% should be borne at its own expense on apartment.
Nevertheless, the Defendants filed an application with the victim for the subsidization of construction costs for two projects, such as the above garbage collection site and the bicycle storage facility, and filed an application with the victim Gangnam-gu for a further subsidy from the Gangnam-gu Gangnam-gu to cover the construction cost for the said three projects with the said money. The Defendants are F, G, H, I, J, J, and K as the residents of the above apartment.
