Defendant

A, B, C, D, and E were the occupants of I apartment in Gangnam-gu Seoul Metropolitan Government, and the representatives of each floor around 2010. Defendant F was the occupants of the above apartment, and was the representatives of each floor around 2009.

Under the Gangnam-gu Seoul Special Metropolitan City Ordinance on the Support for Management of Multi-Family Housing, the victim Gangnam-gu Seoul Metropolitan Government subsidized expenses incurred in the installation and repair of some facilities of multi-family housing located in Gangnam-gu with the Gangnam-gu budget in order to create a pleasant residential environment, and in the case of the improvement of the facility for garbage collection and the repair of the bicycle storage, 70%

On February 2, 2010, the Defendants decided to install garbage collection facility construction works, bicycle storage facility repair works, and post-gate security room installation works on the above I apartment complex. The total construction cost is KRW 28 million, and the latter is not included in the subject of support by the victim. In the case of improvement of garbage collection facilities and bicycle storage facility repair, the damaged person subsidized 70% of the total construction cost and the remainder 30% of the total construction cost should be borne at his own expense on apartment.

Nevertheless, the Defendants filed an application with the victim for support of construction expenses for two projects, such as the foregoing garbage collection and bicycle storage facilities, and filed an application for a large amount of subsidy from the injured party, and conspired with the chairman J, K, and the apartment management center M to cover the construction expenses for the said three projects with the said money.

Accordingly, on February 25, 2010, the above J and M together set forth an application for multi-family housing management support and the total construction cost for the above construction work as KRW 32,80,000,000,000,000,000,000 from the Gangnam-gu office in Samsungdong, Gangnam-gu, Seoul, to the N-gu office for N in charge of the improvement of waste storage facilities and bicycle storage. Of them, the above I apartment is to bear KRW 984,00,000,000,000,000,000,000 won.
