A defendant shall be punished by imprisonment with prison labor for up to six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. A theft Defendant: (a) around 01:50 on June 25, 2019, at the “D convenience store” in the operation of the Victim C located in Changwon-si, Changwon-si; (b) took advantage of the gaps in which the victim’s surveillance was neglected; and (c) stolen the amount of KRW 1,377,650 in total from the victims to July 2019, the Defendant used tobacco equivalent to KRW 9,000 at the market price of KRW 1,37,650 in the following manner, as indicated in the list of crimes, as indicated in the list of crimes.
2. Fraud or violation of the Specialized Credit Finance Business Act;
A. On July 18, 2019, around 22:39, the Defendant presented the Agricultural Cooperative Card in the name of G, as indicated in attached Table 18, to the employees of the convenience store, as if he/she was his/her card, from the “F” in the operation of the victim’s nameless box E located in Changwon-si, Changwon-si, Busan, as indicated in attached Table 18, and received payment for goods, such as tobacco and foodstuffs worth KRW 41,950 in total market value.
B. At around 22:51 on July 18, 2019, the Defendant’s “I” for the operation of the victim’s name and poor boxes located in the Simsan-si, Changwon-si, Changwon-si.
The Nonghyup Card in the name of G was presented to the victim as if it was his own card and was provided by the victim with food price of KRW 21,000 in total in the market price.
C. On July 19, 2019, around 00:48, the Defendant was at the “K” in the operation of the victim’s name and unclaimed boxes located in the Changwon-si, Changwon-si.
The Nonghyup Card in the name of G was presented to the employees of the above convenience store as if it was its card, and was issued with payment of the total amount of 17,500 won of tobacco and foodstuffs equivalent to the market value.
Accordingly, the defendant acquired a total of 80,450 won from the victims on three occasions, and used a stolen credit card.
