A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
On August 29, 2014, the Defendant was sentenced to six months of imprisonment for fraud at the Seoul Central District Court on April 21, 2015, and the execution of the sentence is terminated at the Seoul Western District Court on April 21, 2015, and on May 27, 2014, the Seoul Western District Court sentenced two years of suspended execution to eight months of imprisonment for special larceny, which became final and conclusive on June 4, 2014.
Criminal facts
1. On September 16, 2015, from around 17:00 to around 18:00 of the same day, the Defendant intruded the victim’s “Diplomatic Association” located in Jung-gu Seoul Metropolitan Government, and waited for the time of leaving all the members from the underground distribution of the above building until around 01:00 on the following day, the Defendant was waiting to leave the said victim’s market price of KRW 700,000,000.
Accordingly, the defendant invadedd the structure and stolen the victim's property.
2. Night building thief;
A. On September 20, 2015, around 20:50, the Defendant: (a) removed the unclaimed and unclaimed glass windows from the victim’s meeting located in Jung-gu Seoul Metropolitan Government E; and (b) stolen them with the cash of KRW 80,000 owned by the victim, who was kept in the front of the first floor office.
B. On September 23, 2015, at around 01:36, the Defendant intruded the victim “H guard group” located in Jung-gu Seoul Metropolitan Government, with the entrance door opened, and then, the Defendant’s indictment of KRW 1,200,000, which is the victim I-owned market price of the victim I-owned in the second floor office (PC), and KRW 50,000,000, is stated in the indictment of KRW 1,200. However, according to the evidence indicated in the judgment, the Defendant’s prosecutorial office’s interrogation protocol, investigation report (the content of the victim’s I-owned currency) is recognized as KRW 50,00,000.
A total amount of KRW 1,250,000 was stolen with property equivalent to that of KRW 1,250,000.
C. The Defendant, around 20:00 on September 27, 2015, continued to seek iron at the “K church” for the victims of the second degree of JJ in Jung-gu, Seoul.
