If the defendant fails to pay the above fine, 50,000 won shall be one day.

피고인은 2011. 8. 24. 21:00경 서울 마포구 C 앞길에서, 휴대폰 판촉 행사장의 풍선을 받기 위해 줄을 서있는 피해자 D(여, 38세)에게 ‘나이도 많은데 네가 왜 이런 것을 받느냐 ‘고 말하며 시비를 걸다가 피해자가 대꾸를 하지 않고 그 자리를 피해 직장 거래처 지인인 E 등 2명과 부근 횡단보도를 건너가자, 계속하여 피해자를 뒤쫓아 오면서 위 E 등 거래처 지인 2명과 횡단보도를 건너가는 다수의 행인들이 있는 가운데 피해자에게 ”아줌마!“, ”늙은 년 너 나랑 할래 “, ”너 오늘 집에 가지마라“, ”집에 안 가면 안 되냐 이 쌍년아! 말을 해, 내가 물어보면 대답해야지“, ”늙는 년 주제에 튕기냐 “고 큰소리로 말하여 공연히 피해자를 모욕하였다.

The summary of the facts charged is as follows: (a) the Defendant, at the same time and place as indicated in the facts charged in the judgment; (b) returned the victim’s head debt to the victim; and (c) committed an indecent act by force against the victim by deceiving the victim’s chest with a bad hand.

2. The defendant asserts that there is only a statement at an investigative agency and a court after the suspect interrogation of D's police as evidence consistent with this part of the facts charged, and that there is no fact that D's chest was delivered to the investigative agency and the court, and that there was no indecent act.

In other words, the following circumstances recognized by the statement of the defendant and witness E, F, G court and investigative agency, the photograph of the defendant's injured part, the injury diagnosis report (investigative record 53 pages) and other records, which are criminal facts of the defendant.
