A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

In using and managing access media, no person shall borrow or lend, keep, deliver or distribute access media with the knowledge that such media is to be used for a crime or to be used for a crime.

피고인은 2018. 2. 초경 ‘ 위 챗’ 을 통해 ‘C’ 이라는 대화 명의 성명 불상자( 이하 ‘C’ 이라 함 )로부터 지시하는 대로 일을 하면 일당 40만 원을 주겠다는 제안을 받아 이를 수락하였고, 이후 C이 소개한 ‘D’ 이라는 대화 명의 성명 불상자와 ‘E’ 이라는 대화 명의 성명 불상자( 이하 ‘E’ 이라 함 )로부터 접근 매체인 체크카드의 수령 및 보관 등을 지시 받으면서 다른 사람에게 발각되지 않게 조심하라는 말을 듣는 등 그 접근 매체가 보이스 피 싱 범행에 이용되고 있다는 사정을 알게 되었다.

피고인은 2018. 3. 2. 경 부천시 송 내대로 239에 있는 부천 터미널 내 수화물 센터에서 E으로부터 ‘ 위 챗’ 을 통해 수화물을 찾으라는 지시를 받아 위 수화물 센터에 보관 의뢰된 F 명의의 스탠다드 차 타드 체크카드( 카드번호 : G) 1 장이 들어 있는 상 자를 보이스 피 싱 범행에 이용하기 위해 수령하여 이를 보관한 것을 비롯하여 별지 범죄 일람표의 기재와 같이 총 9개의 타인 명의 체크카드를 수령하여 보관하였다.
