Reasons
Punishment of the crime
1. Quasi-Rape;
A. On October 26, 2019, the Defendant: (a) around 06:08, the victim B (a) who was aware of online game “G” from the E Building F, which is a residence of D located in Seo-gu Daejeon, Seo-gu, Daejeon (hereinafter “Seoul”); (b) reported the appearance of the victim B (a person, South, and the age of 24) under the influence of alcohol, and placed his/her finger in the victim’s resistance.
Accordingly, the defendant committed an act of putting the fingers into the resistance of the victim who has been unable to resist due to the influence of alcohol.
B. At around 02:30 on November 10, 2019, the Defendant: (a) reported the victim H (a person, South, and 19 years old) who was aware of online games through “G” in the mutual influence in Seocho-si I; and (b) performed an act of putting the victim’s panty and inserting his finger into the victim’s resistance.
Accordingly, the defendant committed an act of putting the fingers into the resistance of the victim who has been unable to resist due to the influence of alcohol.
2. Habitual indecent acts by compulsion;
A. On June 29, 2019, the Defendant: (a) around 04:59 on June 29, 2019, the Defendant reported the victim H (the name, remaining, and the age of 19) was locked while under the influence of alcohol at the residence of J where the Defendant committed an indecent act on the victim’s sexual organ with his/her own hand, and committed an indecent act.
B. On August 11, 2019, the Defendant committed the crime, around 06:57, around August 11, 2019, committed an indecent act against the victim under the name-free victim’s name that he/she became aware of through online game “G” in the mutual influence in Hongcheon-gun, Hongcheon-gun, Seocheon-gun, by reporting that the victim was under the influence of alcohol, and making the victim’s panty and panty, and taking charge of the victim’s sexual organ with his/her own hand, committed an indecent act against the victim.
