피고인은 2013. 10. 14. 20:40경 서울 강북구 B 앞 노상에서, 승용차를 운전하여 골목길을 지나가던 중 피해자 C가 차량 앞으로 걸어가면서 비켜주지 않아 경적을 울리자 피해자가 “이 씨발새끼야, 왜 빵빵거려 ”라고 욕설을 하였다는 이유로, 피해자의 얼굴을 주먹으로 3대 때리고, 가슴과 복부를 발로 3회 가량 걷어차 피해자의 입술을 터트려 피가 나게 하는 등 피해자에게 치료일수 미상의 상해를 가하였다.
