1. 재물손괴 피고인은 2019. 4. 28. 18:15경 귀에 이어폰을 끼고 음악을 들으며 강릉시 C에 있는 ‘D’ 주점 앞 도로 위를 걸어가던 중, 피해자 B(37세)가 E BMW 승용차를 운전하여 도로를 진행하고 있는데도 피고인이 비켜주지 아니하여 경적을 수차례 울리자 화가 나 피해자에게 “씨발놈아”라고 욕설을 하고, 이어서 피해자가 도로변에 승용차를 주차하고 하차하여 피고인에게 다가와 “왜 차도로 다니느냐 욕설은 왜 하는 것이냐 ”라고 따지자 피해자에게 “내가 네 허락을 받고 다녀야 하냐 ”라고 말하고 욕설을 하며 승용차 운전석 옆에 서 있던 피해자를 옆으로 밀고 승용차 운전석에 탑승한 후 운전석 문을 닫고 “앞에 박아 부숴 줄까 ”라고 말을 하여, 피해자가 피고인의 행동을 촬영하기 위해 피해자 소유인 시가 미상의 휴대폰을 꺼내 피고인을 촬영하려고 하자, 손으로 휴대폰을 쳐 휴대폰이 승용차에 부딪히고 바닥에 떨어지게 하여 휴대폰의 액정을 파손하였다.
