A defendant shall be punished by imprisonment for three years.

1. Crimes related to misappropriation in the name of E or F;
A. Fraud - The Defendant borrowed his/her resident registration certificate, mobile phone, etc. from E to the effect that he/she “to have a vehicle in a tax problem move to four times.” On January 9, 2017, the Defendant applied for a loan under the name of E by phone calling to the victim E’s E mobile phone Savings Bank, Inc., the victim Svia Savings Bank at that time, and the Defendant applied for the loan under the name of E.
As above, the Defendant: (a) deceiving the Victim SB Savings Bank; (b) received 6 million won from the Victim SB Savings Bank on the same day; (c) applied for a loan in the name of E in the same manner; and (d) obtained 5 million won from the Savings Bank on the same day; (b) obtained 2 million won from the Victim Social Loan Co., Ltd. on the 10th of the same month; (c) obtained 2 million won from the Victim Co., Ltd. on the 17th of the same month; and (d) obtained 3 million won from the Victim Co., Ltd. Loan Finance on the 17th of the same month; and (e) obtained 18 million won in total from the Victim Co., Ltd. on the 17th of the same month.
B. The Defendant opened a mobile phone in the name of E and F without permission of E and F, using the following resident registration certificates of E secured as above, E’s resident registration certificates, and E’s resident registration certificates of Dong F received from E, and received from E, with a view to raising money by selling them to the purchaser of the mobile phone.
(1) On January 26, 2017, the Defendant prepared two copies of the application form for mobile phone joining from G in Jin-si, Jin-si, and signed the “E” in the column for the customer’s personal information as he/she is E, and submitted it to the sales employee, respectively, and issued two mobile phones of the shipment price of KRW 1,152,80 from the sales employee.
