A defendant shall be punished by imprisonment for one year.

An application for remedy by an applicant for remedy shall be dismissed.

Punishment of the crime

[Criminal Power] On August 17, 2018, the Defendant was sentenced to six months of imprisonment for fraud at the Busan District Court on October 14, 2018, and completed the execution of the sentence at the Busan Detention Center.

【Criminal Facts】

On November 6, 2019, the Defendant posted a notice to the effect that “the sales of game money” by accessing the Internet game “C” website at the Busan FPC located in Busan, and that “the Defendant would send money later than the first sending of money to the victim D who contacted the said notice.”

However, even if the defendant received money from the victim, he did not have the intention or ability to sell the game money.

As such, the Defendant, by deceiving the victim, received 150,000 won from the victim’s E bank account (F) in the name of the Defendant on the same day, and from that time, acquired 12,210,650 won in total over 35 times from December 20, 2019, as shown in attached Table 1.

On November 8, 2019, the Defendant stated to the effect that “The Defendant would send money in the face of transfer of money to the victim by visiting the victim’s 'game money purchase’, posted by the victim’s H by accessing the 'Internet’ website in the vicinity of the ideology and thought terminal located in Busan, and that “the Defendant would send money in the face of transfer of money.”

However, even if the defendant received money from the victim, he did not have the intention or ability to sell the game money.

The Defendant, by deceiving the victim as such, received 76,000 won from the E bank account (F) in the name of the Defendant on the same day under the name of the victim for the purchase price of game money.

On December 10, 2019, the Defendant posted a letter to the effect that he/she had access to the “I” website and sell the “J”, an I Game item, at a mutual infinite-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-si around December 10, 201, and first transfers money to the victim K who has reported and contacted it.
