A defendant shall be punished by imprisonment for not less than one year and six months.

The defendant shall complete the sexual assault treatment program for 40 hours.

"2019 Highest 4139"

1. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Kameras and photographing);

A. On July 21, 2019, from 23:00 to 02:00 on the following day, the Defendant set up a Defendant’s mobile phone (three-one-one-one-one-one-one-one-one-year-year-year-old mobile phone) on his customer, and taken a video image of the form of sexual intercourse with the victim using the victim’s cell camera function.

B. On August 8, 2019, the Defendant: (a) set up a cell phone (gallona City9) of the Defendant on his table, set up a cell phone on his table; (b) taken a video image of the victim’s sexual intercourse with the victim using the camera function of the aforementioned cell phone; and (c) taken a photo of the victim’s balone who continued to have sexual intercourse with the victim, after having sexual intercourse with the victim.

C. At around 00:00 to 03:00 on October 12, 2019, the Defendant set up a Defendant’s mobile phone (trigal gal lusium9) on his/her own books within the Defendant’s residence, and taken a video image of his/her sexual intercourse with the victim by using the Defendant’s cell camera function of the aforementioned mobile phone (n, 34 years old, household name).

Accordingly, the defendant taken the body of the victims who could cause sexual humiliation or shame by using a mobile phone with a camera function against their will.

2. Attempted crimes;

가. 피고인은 2019. 10. 12. 15:08경 ~ 다음날 20:28경 전북 전주시 덕진구 E건물, F호에 있는 피고인의 주거지 내에서, 휴대전화 카카오톡 메시지로 피해자 G에게 위 1의 다항의 동영상 중 일부를 캡처한 사진 3장과 함께 “어제 섹스동영상 찍었다, 그냥은 못 지우지ㅋ, 돈 좀 보내줄 수 있어 , 500만, 왜 나중에 교수 안할거야 , ㅋㅋ 이거 퍼지면 어쩌려구, 100만 보내줘.”라는 취지의 메시지를 전송하면서...
