A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On July 16, 2017, at around 21:37, the Defendant took visual images of a female-friendly job offering victim C (MM-A310NO) in Seo-gu Daejeon, Seo-gu, Daejeon, with a camera of his mobile phone (MM-A310NO).

Accordingly, the defendant taken the body of the victim who could cause sexual humiliation or shame by using the cell phone camera function against his will.

2. On July 16, 2017, at around 21:49, the Defendant taken a visual image of the victim’s house at the victim’s house as described in the foregoing paragraph 1, the victim, who sits in a bed with a cellular phone, and calls a telephone call, using the cell phone as described in the foregoing paragraph 1.

Accordingly, the defendant taken the body of the victim who could cause sexual humiliation or shame by using the cell phone camera function against his will.

3. 피고인은 2017. 7. 20. 20:03 경 위 1 항 기재 피해자의 집 안방에서, 그곳 테이블 위에 위 1 항 기재 휴대전화의 카메라 기능을 켠 상태에서 침대 쪽을 향하게 올려놓고 피해자와의 성관계 장면을 촬영하려고 하였으나 피해자가 이를 발견하자 휴대전화를 넘어뜨려 성관계 장면을 촬영하지 못하고, 소리만 녹음되게 하여 그 뜻을 이루지 못하고 미수에 그쳤다.

4. On August 10, 2017, around 20:37, the Defendant: (a) taken visual images of the victim, who was seated in a sofa, using a camera of the mobile phone (M-A3310N in Samsung Gallon) owned by the Defendant, with his/her cell phone (M-A310N in the gallon of Samsung C).

Accordingly, the defendant taken the body of the victim who could cause sexual humiliation or shame by using the cell phone camera function against his will.
