1. Joint criminal conduct by Defendant A and B;
A. At around 23:00 on July 19, 2012, the Defendants found one driver’s license lost by the victim F on the street in front of the Suhyup-dong, Sinsan-si, Sinsan-si, and 30,000 won of the market price equivalent to 30,000 won, which includes one driver’s license lost by the victim F on the street.
The Defendants, in collusion, embezzled the above acquired wallets without going through necessary procedures, such as returning them to the victim.
B. The Defendants: (a) opened a mobile phone using the above F's driver's license acquired as in the preceding paragraph; (b) sold the mobile phone; and (c) sold the mobile phone to raise funds for living expenses, entertainment expenses, etc.
1) On July 26, 2012, the Defendants entered the Gunsan City G on July 15, 2012, and entered the two subscriber column of the application form kept there, stating “F”, “H” in the resident registration number column, and “F” in the buyer column in Chapter II of the application form for joining the cell phone, and subsequently, entered two cell phone units (J, K) by delivering it to I by the said agent operator. Accordingly, the Defendants forged two copies of the application form in the name of F, a private document concerning rights and obligations, and issued two copies of the application form in conspiracy to the said I as if they were duly formed. (2) In the process of opening the cell phone, the Defendants attempted to open a new account by using the personal information of F, when the account number in the name of the subscriber is needed.
The Defendants enter the YAF in Samnam-si, Samnam-si on the same day at around 16:39, and Defendant B entered the name of “F”, “H” and “H” in the column of resident registration number of the bank transaction application form kept there, and signed of “F” in the name following the name.
