A defendant shall be punished by imprisonment with prison labor for up to six months.

The defendant pays 120,000 won to B who is an applicant for compensation.

Punishment of the crime

On May 1, 2019, the Defendant was sentenced to imprisonment with prison labor for four months for a violation of the Road Traffic Act (unlicensed Driving) in the Daegu District Court and racing support on May 1, 2019, and withdrawn an appeal on December 10, 2019, and the first instance judgment became final and conclusive as it is.

In order to raise living expenses even though the Defendant did not have an intention or ability to sell opphone8, etc., the Defendant reported the sale of the above goods on the used goods trading site, and attempted to receive the price from the victims who contacted, and acquired the price by fraud.

On June 27, 2019, the Defendant posted a false statement to the effect that “Aphone8 is sold” on the bulletin board of the online medium-line trading site “C”, thereby sending an Aphone8 to the victim D who made contact with the Defendant.

The Defendant received a total of KRW 2,80,000 from the victims in total nine times from July 2, 2019, including a transfer of KRW 280,00 from the victims to the corporate bank account (E) in the name of the Defendant on the same day, from the victims, from that time by the same method as in the list of crimes in the attached Form.

Accordingly, the defendant was provided property by deceiving the victims.

In order to raise living expenses even though the Defendant did not have an intention or ability to sell opphone8, etc., the Defendant was willing to receive the price from the victims who had contacted with it and acquired the price by fraud in order to raise living expenses.

At around 20:00 on July 12, 2019, the Defendant posted a false statement to the effect that “G sells Aphone 8 Popphones” by accessing F.C., an online medium-sized trading site, and sending money to the victim H who reported and contacted, the Defendant sent Aopphone 8.

The defendant is a post office bank account in the name of the defendant on the same day from the victim.
