『2019고단2884』 피고인은 2019. 3. 23. 인터넷 중고물품 거래 사이트인 ‘B’에 ‘에어팟을 판매하겠다’는 취지의 허위의 글을 게시한 후, 위 게시글을 보고 연락한 피해자 C에게 ‘돈을 송금하면 에어팟을 보내주겠다’라는 취지로 거짓말을 하였다.

그러나 사실 피고인은 에어팟을 가지고 있지 않았고, 피해자로부터 돈을 송금받더라도 이를 에어팟을 구하는데 사용하지 않고 피고인의 생활비 등에 사용할 생각이었으므로 피해자에게 에어팟을 보내줄 의사나 능력이 없었다.

Ultimately, the Defendant, by deceiving the victim as above, received 220,000 won from the E bank account (Account Number:F) in the name of the Defendant used by the victim on the same day from the victim and acquired it by transfer, and then received 560,000 won in total from around that time to March 29, 2019 through the above method, as shown in the attached crime list, from March 29, 2019.
