【Criminal Facts】

Around November 6, 2019, the Defendant posted a false statement on the Internet R’s website that “The sale of LGNopt North Korea” would sell 300,000 won to the victim CH who visited the Defendant at his/her home if he/she remitted 30,000 won to the victim CH.

However, the defendant had no intention or ability to sell the above goods from the beginning, and was planned to use the above money for the cost of living by receiving the money from the victim.

As above, the Defendant, by deceiving the victim as above, received 30,000,000 won from the victim for the same day as the sale proceeds, and received total of 3,261,000 won from August 13, 2019 to November 26, 2019, as shown in the list of crimes.

1. 피해자 CI에 대한 사기 피고인은 2019. 9.경 수원시 권선구 CJ건물 CK호에 있는 피고인의 집에서 휴대전화로 인터넷 중고물품 거래 사이트인 ‘R’에 접속하여 에어팟을 판매한다는 글을 올린 뒤, 2019. 9. 29.경 이를 보고 연락한 피해자 CI에게 90,000원을 송금해 주면 에어팟2세대를 택배로 보내주겠다고 말하였다.

그러나 피고인은 같은 판매글을 보고 연락한 다수의 구매자들로부터 돈만 송금받아 생활비 등으로 소비하고 연락을 두절할 계획이었기에 피해자에게 에어팟을 보내줄 의사나 능력이 없었다.

Nevertheless, the Defendant received 90,000 won from the victim’s account under the name of the Defendant on the same day after the victim’s false statement as above.
