Reasons
Punishment of the crime
The defendant is the owner of the ship of Busan 61.00 tons ship as port transport businessman.
On December 18, 2012, C, the captain of the above ship and the marine pollution prevention manager of the above ship, who are the employees of the defendant, transferred the oil in the fuel oil tank B, which was located in the fuel oil tank at the port of the player's port, to adjust the draft water, around 17:20 on December 18, 2012.
In such cases, C has a duty of care to safely transfer oil by examining the appropriateness of the transfer method and the suitability of input equipment in order to prevent the marine outflow of oil that may arise in the process of transfer. Accordingly, when transferring oil through rubber strings, a single string with sufficient pressure in order to prevent high pressure and heat from spreading of string due to high pressure, and even when using the strings by linking it, it should be bound so that the connection level of string can not be removed.
Nevertheless, C, as it is not sufficient to use the rubber strings connected from the fuel pumps in the engine room to the port side fuel oil tank, C, with the length of the rubber 2 meters in length inside the ship connected to the above strings, operated fuel transfer pumps after inserting the horse string of the strings in the port side fuel oil tank in connection with the above string.
However, the connecting heading, however, was worn out and the connecting heading did not end down to the end of the high pressure so that the connecting heading can with it break down.
In the process of transferring oil with a high pressure in the ice because of the negligence of such defendant, the oil load with the operation of fuel transfer pumps has come to a low temperature, and when the oil has come to a high pressure in the ice, the oil load with the ices dismantled and being transferred has been injected into B deck, and approximately 60 liters of these are leaked into the sea.
