The defendant shall be innocent.

1. The summary of the facts charged is the person who was the vice-chairperson of the “B Promotion Committee for the Establishment of the Housing Redevelopment and Improvement Projects (hereinafter “the former Promotion Committee”)” and was dismissed by C, who was the chairperson of the said Promotion Committee, by means of a residents’ general meeting on August 7, 2015, and was in charge of the duties of the said Promotion Committee’s Chairman. Around October 2, 2015, the Defendant was dismissed by a resolution of dismissal of the Defendant at the above Promotion Committee’s general meeting on behalf of the chairperson.

For this purpose, the defendant prepared a service contract, which is a private document on rights and duties, using the qualification of the chairman of the promotion committee to act on behalf of the chairman.

B. The Defendant, at the time, at the time, and place specified in Paragraph 1, exercised the service contract to G by a representative director of the (State) F, who knows that the contract was duly concluded.

2. In a lawsuit seeking confirmation of invalidity of a residents' general meeting filed by C, who was the chairperson of the said promotion committee, against the said promotion committee (this court 2015Gahap4662, Busan High Court 2016Na52142), the defendant filed a lawsuit on behalf of the said promotion committee in the position of "the acting chairperson of the promotion committee". When the status of the defendant was at issue in the appellate court of the said lawsuit, the said promotion committee is the defendant at the promotion committee of October 2, 2015.
