Reasons
1. Basic facts
A. The Defendant entered into a contract with AD Co., Ltd. and AE for the first and second new construction works and the second new construction works (hereinafter referred to as the “instant construction works”) at the time of Pakistan, and subcontracted among them to AG Co., Ltd. (hereinafter referred to as “AG”).
B. The Plaintiffs and the designated parties provided labor to the construction site of this case as a worker employed in AG.
C. AG requested the Defendant to pay the wages, food expenses, equipment expenses, etc. to be paid by AG within the scope of the flag altitude, upon filing a request for each month from June 2017 to November 2017.
Accordingly, upon the above request, the Defendant deposited the wages from June 2017 to November 2017 to the Plaintiffs’ account. D.
AG suspended subcontracted construction works on December 31, 2017, and concluded settlement on January 2, 2018 with Defendant as KRW 234,740,000 ( KRW 85,580,000 + KRW 26,400,000 + 26,50,000 of primary reinforced concrete construction + 26,40,000 of primary reinforced concrete construction +20,000 +29,000 of primary reinforced concrete construction).
Since then, on April 6, 2018, the Defendant deposited KRW 242,440,000, including KRW 7,700,000 paid-in construction payment on November 2017 in the above settlement agreement amount, under the Sung-nam District Court Branch of Suwon District Court Decision 2018Hun-Ga1332 on the grounds that the transfer, provisional attachment, seizure, etc. of the claim for construction price against the Defendant of AG is concurrent.
E. Meanwhile, on February 11, 2018, the Defendant remitted to the Plaintiff KRW 10,536,055, which was part of the wages of the Plaintiff and its employees on December 2017.

2. The assertion and judgment
A. The Plaintiffs, between the Defendant, AG, and the Plaintiffs, are the Plaintiffs, who are the daily workers of AG.
