피고인은 2012. 10. 14. 18:30경부터 2012. 10. 15. 01:10경까지 사이에 서울 광진구 C, 201호에 있는 피고인의 집에서 술에 취한 채로 귀가해 평소 돈을 벌어오지 못하는 자신을 처인 피해자 D(여, 54세)이 무시한다고 생각하여 피해자에게 소리를 지르고 욕설을 하다가 피해자를 밀쳐 넘어뜨려 피해자의 머리를 불상의 곳에 부딪치게 하여 0.7cm 정도의 뒤통수 부위 좌열창을 가하고, 계속하여 피고인은 강제로 피해자 옷을 전부 벗기고 피해자 팔을 누르고 피해자 왼쪽 유두를 이빨로 깨물어 열창을 가하고, 피해자 머리채를 잡고 바닥에 여러 차례 찧고, 피해자 머리 이마와 두정부 사이를 불상의 물체로 가격하여 피해자에게 머리뼈 골절, 뇌경질막 밑 출혈, 뇌좌상 등을 가하였다.

As a result, the Defendant caused the death of the victim at the above date, time, and place, due to damage to the head and father of the victim.
