피고인은 전화금융 사기( 이하, ‘ 보이스 피 싱’ 이라고 한다) 조직원인 위 챗( 중국 스마트 폰 메신 져 어 플 리 케이 션) 대화명 ‘E’, ‘F’, ‘G (ID : H) '로부터 지시를 받아 피해 자가 보이스 피 싱 조직원에게 피해 금을 전달하는 현장에서 피해자의 동선을 파악하거나 망을 보고 1건 당 10만 원에 해당하는 수수료를 받기로 하는 등 보이스 피 싱 조직의 현장 감시 책 역할을, M은 보이스 피 싱 조직의 자금 운반 책으로부터 피해 금을 전달 받아 보이스 피 싱 조직에 송금하고 1건 당 20만 원에 해당하는 수수료를 받기로 하는 등 보이스 피 싱 조직의 송금 책 역할을, 성명 불 상의 보이스 피 싱 조직원은 수사기관 등을 사칭하여 피해자들에게 전화하는 역할을, I, J은 피해자들을 직접 만나서 피해 금을 전달 받는 역할을, 일명 K( 이하 ’K‘ 이라 함) 은 피고인으로부터 피해 금을 건네받아 성명 불 상의 보이스 피 싱 조직원에게 전달하는 역할을, 일명 L( 이하 ‘L’ 이라 함) 은 M 에게 보이스 피 싱 조직에 송금할 계좌를 알려주는 역할을 맡는 등, 피고 인은 위 ‘E’, ‘F’, I, J, M, 성명 불 상의 보이스 피 싱 조직원 등과 보이스 피 싱 사기 범행을 하기로 공모하였다.
