피고인은 2014. 4. 30. 18:40경 청주시 상당구 상당로 55에 있는 중앙공원에서 윷놀이를 구경하고 있는 피해자 C(48세)에게 “저 새끼 오면 윷을 놀지 않는다”라고 욕설을 하였고, 이에 피해자가 “왜 그러냐”라고 말하자, 피해자를 밀어 넘어뜨리고 손에 들고 있던 윷가락으로 피해자의 입 부위를 1회 찍어 피해자에게 약 28일간의 치료가 필요한 치근 파절상을 가하였다.
