Defendant
A shall be punished by imprisonment with prison labor for ten months and by imprisonment for eight months, respectively.
However, this judgment is delivered against Defendant B.
Reasons
Punishment of the crime
1. On March 13, 2013, Defendant A was sentenced to imprisonment with prison labor for a violation of the Narcotics Control Act in the Daejeon District Court on the part of March 13, 2013 and completed the execution of the sentence in the Daejeon Prison on February 13, 2014.
2. Criminal facts;
A. Defendant A1) The Defendant at the forged air event exercised the forged air defense by running a vehicle A8 car, which was forged from May 19, 2015 to May 20, 2015, which was received from a son B at the seat of Daejeon, from May 20, 2015.
2) On October 20, 2015, the Defendant violated the Road Traffic Act (unlicensed driving) on and around 02:30 on around 20, 2015, the Defendant driven a car without a license at around 7km section from the front day of the apartment building to the front day of the park in Jung-gu, Jung-gu, Seoul Special Metropolitan City (hereinafter “Seoul Special Metropolitan City”) and operated a car without a license at the same time as that of the above 1).
3) On June 10, 2015, the Defendant sent a phone call to B at an insular place, and instructed B to “A police officer was discovered while driving a motor vehicle while a license was revoked, and as if he driven a motor vehicle on behalf of the police officer, he/she was examined as if he/she driven a motor vehicle.” On June 16, 2015, the Defendant instigated B to avoid committing a crime by having B state as if he/she driven a motor vehicle at the guard of the Daejeon Daejeon Police Station and at the office of the Transport Investigation Team.
B. Defendant B (1) on May 2015, 2015, the Defendant forged the car number plate, which is an air defense, by printing out “one number plate (50cm in width, 10cm in length)” at the home of the signboard in the Seo-gu, Seo-gu, Seo-gu, Seoul, upon receipt of a request from A to damage the car number plate.
2) The Defendant also driven by the Defendant from A, as described in paragraph (3) around June 10, 2015, as well as the Defendant described in paragraph (3).
It is also known that A commits a crime corresponding to a fine or heavier punishment upon request for investigation.
