A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is the owner of the "E Gameland" in the original city D and 3th floor, and F is the employee who is in charge of the overall management of the above game site.

No game products-related business entity shall allow any person to gamble or perform other speculative acts by using game water, or leave such person to do so.

그럼에도 피고인은 2015. 11. 경부터 2016. 2. 25. 경까지 사이에, 위 게임 장에서 게임기를 자동으로 실행시켜 주는 속칭 ‘ 똑딱이’ 장치를 구비한 후, 손님들이 게임기 동전 투입구에 동전을 넣고 위 ’ 똑딱이‘ 장치를 위 게임기 위에 올려놓으면 ’ 바다야‘, ’ 슈퍼 드래곤‘ 등 게임이 자동으로 실행되고 우연에 의해 결정되는 게임결과에 따라 점수를 획득하는 게임기 100대를 설치하고, 그 무렵 피고인 또는 F이 손님들 로부터 게임 물의 이용을 통해 획득한 포인트의 적립을 요구 받으면 그 포인트에 해당하는 만큼 포인트 적립용 플라스틱 카드에 해당 포인트를 적립하여 교부하고, 손님들이 카드를 제시하면 적립된 포인트 만큼 위 게임기에 입력해 주어 손님들이 위 게임을 다시 할 수 있게 하거나, 카드를 소지한 손님이 다른 손님에게 카드를 매매하면 그 카드를 매수하여 카드를 소지한 손님에게 카드에 적립된 포인트를 이용하여 게임을 다시 할 수 있게 하였다.

Accordingly, the Defendant, in collusion with F, put in collusion with F in order for customers to engage in gambling and other speculative acts using game water by giving exchange values to plastic cards for the purpose of accumulating points issued in the above game.
