Defendant shall be punished by a fine of KRW 1,500,000.
When the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
1. On March 15, 2017, the Defendant: (a) around 2017, at D Council members with B second floor level C, the Defendant received medical treatment by misappropriation of the name and resident registration number of E; and (b) instead of knowing that he/she was E; (c) caused an employee under the name of the above Council member to file an application for insurance benefits with the National Health Insurance Corporation; (d) caused the victim to pay KRW 10,460 as insurance benefits to the above hospital in the name of the insurance benefits; and (e) prevented the victim from paying an amount equivalent to the said amount; and (e) caused the victim to pay insurance benefits of KRW 560,585 in total at the same 24 times from November 6, 2018 by means of the same method as indicated in the attached list of crimes.
2. No person who violates the National Health Insurance Act shall receive or allow another person to receive insurance benefits by fraud or other improper means;
Nevertheless, the Defendant had the National Health Insurance Corporation pay KRW 10,460 as insurance benefits to the above hospital by misappropriation of personal information in the time, time, and place mentioned in paragraph (1), and had the National Health Insurance Corporation pay KRW 560,585 in total as insurance benefits to the hospital, pharmacy, etc. over 24 times from around that time to November 6, 2018, as shown in the attached crime list.
3. No person who violates the Resident Registration Act shall unlawfully use another person’s resident registration number.
Nevertheless, the Defendant, at the time and place specified in Paragraph 1, uses E’s resident registration number F as his/her resident registration number to verify his/her identity while receiving medical treatment as E, and from that time, uses E’s resident registration number F as his/her resident registration number until November 6, 2018.
