Defendant shall be punished by a fine of KRW 3,000,000.
When the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
1. The Defendant violated the National Health Insurance Act: (a) around January 5, 2015, at the “C Family Council” located in Ji Government-si B, and (b) as if the Defendant was aware of his/her resident registration number D, the Defendant took care of the Defendant as if he/she was D; (c) received treatment by deceiving employees in the name of the above hospital in the manner of refering to D’s resident registration number and name; and (d) had the National Health Insurance Corporation pay KRW 7,000 to the above hospital from around that time to April 30, 2018; and (c) had each hospital, pharmacy, etc. receive KRW 1,557,490 in total and insurance benefits by false or other unlawful means for a total of 80 times, as shown in the List of Offenses (1).
2. The Defendant violated the Resident Registration Act, upon receiving medical treatment at the date, time, and place as indicated in paragraph (1), unlawfully used another’s resident registration number over 80 times in total, as indicated in the annexed Crime List (1), from around that time to April 30, 2018, as well as from around 80 times the completion of his/her name in the same manner as described in paragraph (1).
3. The fraud defendant, at the "C Family Council member" located in the Guro-si B on November 11, 2010, committed as if the defendant had been aware of his resident registration number D, and received medical treatment by deceiving employees of the above hospital in the manner of refering to D's resident registration number and name and had the victim pay 6,180 won of insurance benefits to the above hospital. From around that time to April 30, 2018, the defendant received medical treatment or purchased medicine in the same way 154 times in total as shown in the crime list (2), and caused the victim to pay insurance benefits of KRW 2,600,110 in total to each hospital, pharmacy, etc., and thereby exempted the victim from the obligation of paying the insurance benefits or medicine expenses.
