Defendant shall be punished by a fine of KRW 2,000,000.
When the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
1. Around January 23, 2015, the Defendant: (a) took care of “C Council members” located in Ansan-gu, Ansan-si; (b) took advantage of D’s name and resident registration number (E); (c) took advantage of D’s identity and resident registration number as if he/she was said D; (d) took care of the said member’s name-free employee, who did not know of such fact, requested the National Health Insurance Corporation to apply for insurance benefits to the victim; (c) thereby, the victim exempted the victim from paying an amount equivalent to KRW 56,770 as insurance benefits in the name of the said hospital from that time to June 22, 2018; and (d) obtained economic benefits equivalent to that amount by allowing the victim to pay insurance benefits of KRW 2,191,460 in total by the same method, such as the written list of crimes, from that time until June 22, 2018.
2. No person who violates the National Health Insurance Act shall receive or allow another person to receive insurance benefits by fraud or other improper means;
Nevertheless, the Defendant had the National Health Insurance Corporation pay KRW 2,191,460 as insurance benefits to hospitals, oriental medical clinics, pharmacies, etc. in a total of 109 times from January 23, 2015 to June 22, 2018 by unlawful means, such as receiving treatment or medicine prescriptions by stealing the above D personal information at the time and place specified in paragraph (1).
3. No person who violates the Resident Registration Act shall unlawfully use another person's resident registration number.
Nevertheless, the Defendant received medical treatment at the time and place specified in paragraph (1) and used D’s resident registration number “E” as one’s own resident registration number from that time to June 22, 2018, and used D’s resident registration number on a total of 109 occasions as indicated in the list of crimes, from that time.
