2. Judgment on the grounds for appeal by the defendant

가. 사실 오인 주장에 대하여 1) 원심이 적법하게 채택하여 조사한 증거를 통하여 알 수 있는 다음과 같은 사정, 즉 피해자는 경찰 조사 당시 ‘ 이 사건 당시 피해 자가 피고인을 경찰에 신고한 후 다시 경찰에서 전화가 와서 수화기에 대고 소리를 지르니까, 피고인이 “ 네 가 죽든지 내가 죽든지, 혼자서는 못 죽겠다” 고 말하면서 주방에 있던 칼을 들고 와서 피해자의 멱살을 잡은 채로 칼을 들이댔다’ 고 진술한 바 있는 점( 증거기록 20 쪽), 피고인도 검찰 조사 당시 ‘ 피해자의 집에 들어가서 피해자와 대화를 하려 하였는데 피해자가 경찰에 신고 하여 피해자와 함께 주방으로 가서 한 손으로 피해자의 멱살을 잡고 다른 한 손으로 칼을 잡은 채로 피해자에게 “ 둘이 같이 죽자, 너와 내가 영적으로 연결되어 있어서 네 가 들어주지 않으면 해결이 안 된다, 네 가 죽든지 내가 죽든지 나는 혼자 못 죽겠다” 고 말하였다’ 고 진술한 바 있고( 증거기록 70 쪽), 당 심에서도 ’ 한 손으로 피해자의 멱살을 잡고 다른 한 손으로 식칼을 잡은 채로 피해자에게 “ 죽을래
