However, this judgment is delivered against Defendant A.

Punishment of the crime

Defendant

On August 23, 2017, A was sentenced to two years of imprisonment with prison labor for a violation of the Act on the Control of Narcotics, Etc. at the Changwon District Court on January 3, 2019, and completed the execution of the sentence in the Cheongju Prison on January 3, 2019. On June 9, 2017, Defendant B was sentenced to eight months of imprisonment with prison labor for a violation of the Act on the Control of Narcotics, etc. at the Busan District Court on February 5, 2018, and completed the execution of the sentence in the Jinju Prison.

Even if the Defendants were not the narcotics handler, they dealt with the psychotropic drugs-related Mesofts (one philophone, hereinafter “philophones”) as follows:

1. The sole criminal conduct of Defendant A;

A. On March 14, 2019, Defendant A paid KRW 350,000 in cash at a Moel where it is difficult to know the trade name located in the Busan YY-gu at the early 14:00, and purchased a philophone with approximately 0.2g of a philophone contained in a vinyl.

B. At around 03:00 on March 31, 2019, Defendant A paid KRW 200,000 in cash to Nam-gu DMoel E at port, Nam-gu, Nam-gu, Seoul, and purchased KRW 00,000 in cash for a single-time injection instrument and approximately 0.08 ghonphones contained in vinyl bags.

As in the same paragraph, two disposable injection devices purchased and approximately 0.08 g of philophones contained in plastic bags were stored in a disposable injection machine.

2. Defendant B’s sole criminal conduct

A. On March 2019, Defendant B purchased philophones from a person with no name, around 23:30 on the first day of March 2019, Defendant B placed KRW 1 million in cash in the H newspaper advertisement room located in the front bus stops located in Busan subway G 4, and purchased philophones by finding out approximately KRW 7.7 g of a disguised philophone with a disguised rophone that was left there.
