1. The defendant

A. As to Plaintiff A’s KRW 6,79,300, Plaintiff C’s KRW 15,039,250, and each said money, from June 12, 2015.

1. Basic facts

A. 1) The Plaintiffs concluded a contract for the supply of original raising with the Defendant respectively, respectively, from November 5, 2013 to June 16, 2014, with the purpose of running original raising farms, and the Defendant is an agricultural company that mainly runs livestock industry, gold breeding and incubation business, and gold sales business. 2) The Plaintiffs concluded a contract for the supply of original raising with the Defendant respectively.

(3) The contract for the supply of original breeding entered into between the Plaintiffs and the Defendant provides the Plaintiffs with materials necessary for original breeding (such as ducks, pathology, and feed), and the Plaintiffs provide the original and deliver the original to the Defendant. The Defendant received the completed original breeding from the Plaintiffs, and paid the remainder of the amount calculated by deducting the price of materials such as pathology and feed, and advance payment from the original price that applied the agreed unit price for payment by weight. Furthermore, the Plaintiffs entered into an agreement for the payment of the purchase price of the materials to the Defendant and the guarantee of the contract performance. (b) Meanwhile, the Plaintiffs agreed to transfer all the original supplied by the Defendant during the contract period to the Defendant for the payment of the purchase price of the materials to the Defendant, and the guarantee of the contract performance. (iii) On the other hand, the Defendant confirmed that the original breeding farm was in the vicinity of the original breeding farm of the Plaintiffs.

2) On January 27, 2015, Naju City slaughtered the originals of Plaintiff B’s original breeding farm (F of Naju) within a 500-meter radius from the said farm under the Prevention of Contagious Animal Diseases Act (hereinafter referred to as “the Plaintiff’s original breeding farm”). The Naju City confirmed the AI training reaction even in the originals of Plaintiff A and C original breeding farm, and destroyed the originals of each farm on January 31, 2015 (Plaintiff A and Plaintiff C1 farm) (Plaintiff C2 farm).
