1. 피고인들의 공동범행 피고인들은 2011. 4. 14. 21:30경 용인시 수지구 E에 있는 “F”에 함께 들어가 위 가게 종업원인 피해자 G(31세)이 친절하게 대하지 않는다는 이유로 화가 나서, 피고인 A은 매장 내에 진열되어 있는 야채와 과일을 손으로 밀어 바닥에 떨어지게 하고 위 G에게 “야 시발놈아 왜 반말이야. 십새끼야 너 죽을래.”라고 욕설하고, 위 G 옆에 있던 위 가게 종업원인 피해자 H(29세)에게 “뭘 봐 십새끼야. 죽을래 눈깔 깔아 시발놈아.”라고 욕설하면서 주먹으로 위 H의 우측 얼굴부위를 1회, 가슴부위를 수회 때려 위 H을 넘어뜨리고, 주먹으로 위 G의 얼굴과 몸통부위를 수회 때리고, 피고인 B은 이에 합세하여 피해자들에게 “시발놈들 죽여버리겠다.”라며 욕설을 하고 주먹으로 위 G의 얼굴과 몸통부위를 수회 때리고, 계속해서 피고인들은 그곳 계산대 위에 있던 시가 1,045,000원 상당의 컴퓨터 모니터 2대를 손으로 밀어 넘어뜨리는 방법으로 이를 부쉈다.
