1. The Plaintiff, and Defendant B, from February 1, 2018, with respect to KRW 42,257,801, and Defendant C, jointly with Defendant B.

1. Facts of recognition;

A. 1) The Plaintiff newly constructed a 500 square meters wide on the ground of 1347 square meters of the D farm site in Namyang-si, Namyang-si, the ownership of the Plaintiff, around 2007, on the ground of 1347 square meters, and remodeled the said facility for the purpose of warehouse around 201. On February 1, 2017, the Plaintiff concluded a lease agreement with Defendant B by setting the lease deposit amount of KRW 20,000,000, monthly rent of KRW 200,000,000, and from February 28, 2017 to February 27, 2019 (hereinafter “instant lease agreement”), and entered the said facility into the “instant warehouse.”

(2) Defendant B, with the trade name of “E”, kept clothes in the warehouse of this case while selling clothing and retail business, and sublet one half of the warehouse to Defendant C conducting the same business as “F”.

B. (1) Meanwhile, around 2008, the Plaintiff was in contact with the instant warehouse, and the Plaintiff was divided into the said warehouse, which is 150 square meters of 150 square meters of a stable of the 1st floor of the steel frame, sand site location plate, and entered into the instant warehouse as “the instant building” along with the instant warehouse.

The building of this case was newly built. The width of the entrance is narrow, and the aspect is a long rectangular angle. In addition, in the case of Namyang-si adjacent to the said site, H and I used as a prefabricated sand position plate building (hereinafter referred to as “nicker warehouse”) used by H and I as a clothes storage store.

(2) On September 1, 2017, the instant building and the first fire signal was generated at the center of the adjacent warehouse at KRW 13:03:39, among the fire reduction center installed on the wall of the instant warehouse, and the first fire signal was generated at KRW 13:03:45, and around KRW 13:03:50, among the licenses installed on the wall of the instant warehouse.

After 13:04:09, the passage is discovered on the roof of the instant warehouse, and the fire is transferred to the roof and outer wall of the instant house and the adjacent warehouse.
