A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
1. Crimes related to victims C;
A. On February 28, 2013, the Defendant made a false statement to the effect that “E, the owner of D apartment 101 Dong 1309, and E, the owner of D apartment 101 Dong 1309, is the owner of D apartment 101 Dong 1309.” The Defendant was delegated with all the rights regarding the lease contract of an apartment from E. The above apartment was to be leased KRW 20 million and KRW 600,000,000,000 in monthly rent.”
However, in fact, the defendant was not the owner of the above apartment, E, but the tenant who leased the above apartment from E, and did not have been delegated the authority to enter into a lease contract for the above apartment, and the right to return the lease deposit for the above apartment was transferred to F to F who is a bond company, and the lease contract was newly made up for F as lessee.
As such, the Defendant, by deceiving the victim as such, received a total of KRW 18,426,790 from the victim to the same securities account in the name of the Defendant under the name of the victim as the deposit money for lease, respectively, and acquired a total of KRW 18,426,790 by remitting KRW 200,000,000 on March 6, 2013, KRW 200,000 on March 11, 2013, and KRW 200,000 on April 6, 2013, and KRW 790 on April 8, 2013.
B. On April 8, 2013, the Defendant forged private documents, without authority, stated the remainder of the lease deposit amount of KRW 6,426,790 from the above D Apartment 101 and 1309, the said D Apartment 101 and 1309, and sealed his/her seal in the column for the location of real estate by using a testing tool in the real estate lease contract form, “20,000,000 won” in the former rent column, “60,000 won” in the monthly rent column, and the lessor column “101,1309, G, H, and E” in the lessor column of Gyeonggi-do.
Accordingly, the Defendant forged one copy of the real estate lease contract in the name of E, a private document on rights and obligations.
