A defendant shall be punished by imprisonment for not less than one year and six months.

Seized evidence 11 shall be confiscated.

Punishment of the crime

On June 4, 2015, the Defendant was sentenced to one year of imprisonment for a violation of the Act on the Control of Narcotics, Etc. at Suwon District Court on December 11, 2015, and completed the execution of the sentence.

Even if the Defendant is not a person handling narcotics, the Defendant received, administered, and possessed psychotropic drugs-related Mesofts (one philophone, hereinafter referred to as “philophones”).

1. Receipt of Handphones;

A. On June 12, 2016, the Defendant: (a) delivered, without compensation, one disposable injection device containing approximately 0.07 grams of philopon to E in the visitors room near the Domotour located in Nam-gu Incheon Metropolitan City, Nam-gu, Incheon; and (b) accepted it.

B. On June 23, 2016, the Defendant: (a) provided, within the guest room located in the Bupyeong-gu Incheon Bupyeong-gu Incheon Bupyeong-gu, Gmophone 208, H with approximately 0.07 grams of philophones without compensation, and received them.

2. Medication of phiphones.

A. On June 12, 2016, the Defendant administered DNA 309 air conditioners in Nam-gu Incheon Metropolitan City, using a one-time injection device with approximately 0.03 gramopon, together with I and J, for one-time injection.

Accordingly, the defendant administered philophones in collusion with I and J.

B. At around 18:00 on June 23, 2016, the Defendant administered Gamoto 208, located in Bupyeong-gu Incheon Bupyeong-gu, Incheon, in a method of injecting approximately 0.03 grams with K for a single-use injection device, using a single-use injection device.

Accordingly, the Defendant conspired with K to administer philophones.

3. On June 23, 2016, the Defendant: (a) around 19:10, held a philophone by taking the 5.63 grams of philophone into account five plastic paper in his/her hand and five philophones; and (b) holding a philophone by taking them into account five philophones in his/her hand and five philograms.
