A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
On March 13, 2009, the Defendant was sentenced to imprisonment with prison labor for five months with prison labor for larceny; (2) on July 2, 2009, a fine of two million won and a fine of five hundred thousand won with prison labor for larceny; (3) on April 1, 201, a fine of three hundred thousand won with prison labor for larceny; (5) on August 26, 201, the Defendant was sentenced to imprisonment with prison labor for eight months with prison labor for larceny; (7) on December 16, 201, with prison labor for two years with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes, etc., on August 23, 2014.
1. On September 29, 2014, around 04:13, 2014, the Defendant: (a) discovered and opened an unrecovered vehicle “Nompicers” vehicle at the underground parking lot of the building C at Jeju, in which the market price of the victim D is equal to KRW 10 million; (b) opened an unrecovered vehicle door; and (c) cut off and stolen the vehicle by putting the vehicle at the speed with the key in the custody of the front goods, from that time until October 14, 2014, the Defendant driven the vehicle of the victims four times in the same manner as the list of crimes (1) in the attached Table (1).
Accordingly, the defendant habitually stolen the victims' property.
2. On September 29, 2014, at around 04:13, the Defendant operated a car without obtaining a driver’s license for the vehicle from the underground parking lot of the building C to the public parking lot located adjacent to GsungF at Jeju on the same day from September 29, 2014, as described in paragraph (1), from around 2km to the public parking lot located adjacent to GsungF at Jeju, and operated the vehicle without obtaining a driver’s license for the vehicle from October 14, 2014 until October 05:00 of the attached list of crimes (2).
