1. Defendant A shall be punished by imprisonment with prison labor for one year.

However, the above sentence shall be executed for three years from the date this judgment became final and conclusive.

Punishment of the crime

1. The sole criminal conduct of Defendant A;

나. 협박 피고인은 2014. 4. 17. 18:00경 충북 충주시 G에 있는 ㈜E 사무실로 전화를 걸어, 피해자 H에게 위 B에 대한 퇴직처리를 내일까지 하지 않으면 가만두지 않겠다고 말하며 “내가 너 씨발놈 어디 사는지 알거든. 너 나 맞닥뜨리면 자신있다 이거지 니 이빨 떼고 이 씨발 놈아, 니 뼈까지 씹어 먹어줄 테니까. 오독오독 씹어먹을 테니까, 이 개새끼야! 니 뼉다구까지 오독오독 씹어 먹어 갖고 소화 다 시켜버릴 테니까 자신있으면 보자. 자신있다고 분명히 너는 나한테 얘기했지.”라고 말하여 피해자가 피고인의 말을 들어주지 않으면 피해자의 주거지로 찾아가 피해자의 생명 및 신체에 어떠한 위해를 가할 것처럼 위협하여 피해자를 협박하였다.

2.
