Reasons
Punishment of the crime
1. The Defendant is a person who works in the kitchen room of “C” located on the sixth floor of the Nowon-gu Seoul Special Metropolitan City, Busan Special Metropolitan City.
On June 1, 2014, the Defendant used gas bags installed at the above “C” cooking room, thereby putting down down strings.
In such cases, due to the characteristics of the string that requires long-time cooking, it has the duty of care to check whether gas sirens are overheated, and when necessary cooking has been completed, it has the duty of care to extinguish the fire of gas bags and prevent gas valves from being locked.
Nevertheless, while neglecting such duty of care as above, the Defendant: (a) neglected to fluorize gas bags; (b) neglected to fluorize all of the fluories, which caused the fluoring of smells; and (c) caused the fluoring of smells remaining in smells; (b) caused the fluoring of the oil bags accumulated in gas bags due to the rise of heat and heat heat; (c) around 04:02 on the same day, the Defendant destroyed KRW 8,153,00 by burning approximately 25 square meters in total, including inside the “C” owned by the Plaintiff, where the said “C” customers, etc. are located, by burning the fluoring of approximately KRW 153,00,00.
Accordingly, the defendant destroyed a building in which people exist due to negligence.
2. On June 27, 2014, at around 10:10, the Defendant entered the criminal3 team office of the Busan High Police Station No. 1105, 1105, Seocheon-si, Seocheon-si, into an investigation into the status of suspect, and completed the investigation without authority, and stated “E” in the statement column of the suspect interrogation protocol as at the end of the suspect interrogation protocol, and forged the signature of the above E in a way that it is printed on the name, i.e.,, the signature of the police station of the Busan High Police Station and the assistant F, a police officer under its jurisdiction, who may know the fact at the seat.
