1. The Defendant’s KRW 30,000,000 as well as the Plaintiff’s annual rate of 5% from October 1, 2014 to January 12, 2017.
Reasons
1. Evidence (A1);
2. Indication of claim; and
A. From January 2012 to April 2013, the Plaintiff loaned a total of KRW 40 million to the Defendant on several occasions, and agreed on October 2013.
B. After that, on February 14, 2014, the Defendant agreed to pay the Plaintiff KRW 30 million up to September 30, 2014.
C. Therefore, the Defendant shall pay to the Plaintiff 30 million won with 5% per annum under the Civil Act from October 1, 2014, the following day after the due date for repayment, to January 12, 2017, the delivery date of a copy of the complaint of this case, and 15% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings, from the next day to the day of full payment.
3. Judgment by public notice (Articles 208 (3) 3, and 194 through 196 of the Civil Procedure Act).
