1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. The Forest Survey Division for the Gyeonggi-do Socheon-gun C, which was prepared during the Japanese Occupation Period, is written by D (D; hereinafter referred to as “D”) as the assessment title for the Gyeonggi-do Socheon-gun E-gun of Gyeonggi-do, the 3rd 7rd 7th YY E-gun of Gyeonggi-do (hereinafter referred to as “instant land before division”); and F (F; hereinafter referred to as “F”) as the assessment title for the 6th YY 2nd 3rd YE of Gyeonggi-gun Gung-gun of Gyeonggi-do (hereinafter referred to as “the land before division”).
B. The land before the instant subdivision was destroyed due to the 625 War, and the cadastral record was destroyed on December 9, 1963, the cadastral record was restored on the old land cadastre by the 3rd 7th 5th Y in the Gyeonggi-gun, Gyeonggi-gun, and the land was partitioned from H on October 28, 1969, the land I through J, and H from H to April 22, 2004; from the 111,103 square meters of H forests and fields, the land listed in attached Table 1 and 2 (hereinafter “instant 1 and 2 real estate”).
C. The land before the instant partition was destroyed by the 625 War, and the cadastral record was destroyed on December 9, 1963, and the cadastral record was restored on the old land cadastre due to the 3rd part of G forest 200,000 square meters, and on February 5, 198, the land was divided into the 10,900 square meters of Nancheon-gun M forest 23,405 square meters and became the land indicated in attached Tables 3 and 4 (hereinafter “instant 3 and 4 real estate”).
On the other hand, the registration of preservation of ownership was completed in the name of P on February 16, 1967 with respect to theO forest in Gyeonggi-gun. On February 5, 1974, with respect to the share of 1650/7350 of the above land on the ground of sale and purchase on June 19, 1974, the registration of ownership transfer was completed on September 12, 1987 for the share of 570/7350 of the above land on September 18, 1987, and thereafter on November 18, 2002 for the share of the above Republic of Korea on the ground that the share of the above Republic of Korea was divided on November 16, 2002.
E. On March 3, 1971 with respect to the forest land M M M in Gyeonggi-do, Gyeonggi-do, the Act on Special Measures for the Registration of Forest Ownership Transfer in the name of P, No. 211, et al.
