Reasons
Punishment of the crime
1. Defendant A is a person who operates a farming association corporation B in Gyeonggi-gun D.
Although no person makes a false indication of origin, the Defendant entered into a contract with Pyeongtaek-gun for school meal service at 94 Gamyang-gun, Ansan-si, and Sungnam-si, but it could not be appropriated for the amount to be supplied to the above school. Accordingly, around March 9, 2012, the Defendant falsely marked the origin of rice 1,600 g purchased from the former North Korea’s “Emimi,” from the Gyeonggi-gun, Gyeonggi-do Agricultural Partnership D, and sold it to the F Elementary School by means of containing the origin in the packaging of the “Gyeong-gun Environment-Friendly rice” marked as the country of origin in Pyeongtaek-gun.
In addition, from around that time to June 28, 2013, the Defendant sold rice produced by Jeonnam Hacheon, etc. with a false indication of the origin equivalent to approximately KRW 640 million in the market price of approximately 217 tons of rice produced by Jeonnam Hacheon, etc.
2. B Defendant B’s agricultural partnership is a corporation with the purpose of building, storage, processing, joint shipment and sale of agricultural products.
