Reasons
Punishment of the crime
1. Violation of the Labor Standards Act;
A. The Defendant is the actual manager of C in Gangnam-gu Seoul Metropolitan Building, who runs an advertising agency business using ten full-time workers.
The Defendant worked in the foregoing workplace from October 1, 201 to March 1, 201, and paid KRW 2,859,420, and KRW 2,859,420, and KRW 2,363,080, and KRW 3,586,440, which were retired from the said workplace from March 1, 201 to around January 1, 2014, while working in the said workplace from around March 1, 2014 to around July 18, 2013, and did not pay KRW 2,586,440, and KRW 2,508,870, which were retired from the said workplace from May 15, 2014 to around May 13, 2014, without any agreement on extension of the payment date of G wages and KRW 2,508,870, which were retired from each workplace.
B. The Defendant is the actual manager of I Co., Ltd. H in Sungnam-si, Sungnam-si, who employs five full-time workers to run a business trip frenching business.
The Defendant, while working in the foregoing workplace from around August 26, 2013 to around November 30, 2013, did not pay KRW 3,456,340 of the J’s wages, and KRW 1,095,170 of the E’s wages, retired from the above workplace from September 23, 2013 to December 31, 2013, without any agreement on extension of the respective payment dates, within 14 days from the date of each retirement.
2. The defendant in violation of the Guarantee of Workers' Retirement Benefits Act is the actual manager of C in Gangnam-gu Seoul Metropolitan Building who operates an advertising agency service business using ten full-time workers.
The Defendant had worked in the foregoing workplace from May 23, 201 to August 1, 201, and had not paid KRW 4,542,770 of the retirement pay of KK retired on or before August 1, 2013, within 14 days from the date of retirement without any agreement on the extension of the due date.
