A defendant shall be punished by imprisonment for four months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Reasons
Punishment of the crime
[2016 Height316] The Defendant is an employer who engages in the manufacturing of steel structure by employing eight full-time workers as the representative of D Co., Ltd. (hereinafter “D”) located in Haan-gun, Haannam-gun, Haan District.
The Defendant, at the foregoing workplace from October 28, 2015 to January 27, 2016, worked as masting and retired workers E, did not pay the total of KRW 4,796,680 paid monthly wages of December 2015, and KRW 8,646,680 paid monthly wages of KRW 3850,00 for January 2016 as well as KRW 5,68,88,9,9,11,12, and 13 of the annual statement of personal overdue money and valuables in arrears in Attached Form 1, as described in the foregoing No. 5,6,8,9,91, 12, and 13, 22,972, and 680 of the total amount of wages of KRW 7 of workers to be paid within 14 days from the date on which the cause for the payment occurred, without any agreement
[2016 Highest 687] The Defendant is the employer who runs the manufacturing business of steel structures by employing eight full-time workers as the representative of D in the Hanam-gun C. Hanam-gun.
The Defendant, as indicated in attached Form 1 No. 1, did not pay KRW 2,436,00, monthly wage of KRW 2,436,00, monthly wage of December 2015, and KRW 3,704,750, monthly wage of KRW 1,268,750, as of January 2016, at the same place of business from November 16, 2015 to January 21, 2016, without any agreement on the extension of the due date between the parties to the payment.

1. When a worker dies or retires, the employer in violation of the Labor Standards Act shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;
Nevertheless, the Defendant, as indicated in the attached Table 3 No. 3, was working in the above workplace from January 21, 2015 to May 31, 2016, and retired from office.
